    Gun Forfeiture Question Comment

    Are other states similar to Florida in that the State will take away your hunting rifle if you are convicted of poaching?

    I agree with the fines, and the loss of hunting privileges, but I'm not so sure about the state confiscating firearms for non-felony offenses. That kinda seems, er, to be of questionable constitutionality to me.

    I doubt anyone will ever say anything about it though since it doesn't happen often, and those it happens to "deserve it".

    Anyone have any thoughts?

    I'm OK with it. At least you have to be convicted of a crime for it to happen, unless the asset forfeiture cases.

    The biggest problem I see is that it can be so VERY EASY to break game laws without realizing it. Then they take your gun (and in some places your truck/boat) and hit you with heavy fines and restrictions.

    Calling the DNR (or DFG or whoever it is in your state) and asking a question can be like calling the IRS- you get a different answer each time. Get caught doing what one employee said was okay but another one says isn't and you could lose an awful lot.

    Here in SC, I'm pretty sure you can lose whatever weapons you have with you and the vehicle(s) you're using.

    In Pennsylvania, you could lose your firearm if you were caught with a spotlight in the car when armed. No matter day or night, so if you had a ccw, you had to go unarmed whenever you had a spotlight.
    That law was just modified, to permit ccw to still carry and spotlight . They still confiscate firearms for other infractions, and have heard of them taking all firearms, not just the one carried during the incident.
    This is before any hearings etc. after being exonerated as in the case of my farmer friend, the lengthy ordeal of reclaiming the property begins.

    In Ohio (or is it Kentucky?), they go even further than that. Beyond taking your rifle, the fine is based on the size of the buck's rack - i believe the calculate total inches, and multiple by a dollar amount. Depending on the kill, you could be facing a $20,000 fine for one deer.

    Personally, I have little problem with it. Calendars are easy to read, and I suspect people hunting out-of-season, or without tags, know full well what they're doing. Poachers just make hunting more difficult (and more criticized) for honorable hunters.
